The popular star chef from Munich did not reveal the vital figures. Now the already bankrupt Schuhbeck has been threatened with higher fines. The BFJ is investigating.

MUNICH/BON – Bad news again from popular Munich celebrity chef Alphonse Schühbeck: Following the Munich Public Prosecutor’s Office, the Federal Office of Justice (BFJ) in Bonn is now taking action against the 72-year-old. Allegation: He has not published any annual report since 2017. Thus he threatens a high fine!

Section 325 of the Commercial Code (HGB) specifies the obligation to publish business data for certain companies (particularly corporations such as GmbH), explains tax law attorney Erkan Alden. Munich*, tz. Schuhbeck has not fulfilled this obligation in many of its companies, as the BFJ notified the DPA. For example, for 2017 and 2018, Schuhbeck’s Holding GmbH & Co. KG and Schuhbeck’s Partyservice GmbH and Co. KG’s balance sheet was missing in the Federal Gazette.

Result: Administrative penalty proceedings initiated against the companies. As a rule, the fine for this is between 2,500 and 25,000 euros.

In Schuhbeck’s companies, a much larger sum could have been raised by now. Because with “continuous refusal,” the fine will be increased more and more, according to the BFJ.

After bankruptcy: lawsuit against Alphonse Schuebeck – Munich cook did not disclose statistics

As mentioned, Schuhbeck filed for bankruptcy last weekend. Restaurant visitors suddenly found themselves in front of closed doors. In addition, tax investigations have been going on against him for a long time, as he himself admitted.

Why did he not comply with the obligation to disclose business data? How can a company fail to do this? “The reasons can vary,” says attorney Erkan Alden. “Deliberately withheld from ‘not considered’ in order not to make any wrong numbers public.” But speculation is prohibited, “since each individual case has to be considered separately”. Schuhbeck himself did not want to comment on the latest legal trouble Friday, according to his lawyer when tz asked. (branch) *tz.de an offer from ippn.media
